UPDATE - Ashgrove Lane Easement - Deed of Vacation

Dear Westwood Village Owner,

As promised, the Board of Directors has reviewed this matter in detail and consulted with a land use attorney to arrive at a recommended course of action for all Westwood Village Condominium owners.  Our recommendations are the following:
  • All Owners and Tenants should go to the Tysons West Community Open House on Saturday September 22, 2012 from 10:00am to 2:00pm in the Sheraton Premier hotel in the “Great Falls” room located in the lower lobby.  JBGR will provide additional information about the easement and Phase 2 & 3 of their development.
  • The land use attorney, hired jointly by the Condo and Townhome associations, recommends that owners sign the Deed of Vacation.  The Ashgove Lane easement lost it purpose when VDOT close the roads access to route 7.  JBGR assumed the easement as part of their land purchase for its Phase 1 development (currently under construction).   If we were to go to court, the fight would be against VDOT, which nullified the purpose of the easement, as well as with JBGR, the owner of Ashgrove Lane.  This court battle cannot be won by our associations and it would cost an enormous amount of legal fees.  In any case, JBGR will go to Court to vacate the easement because it will not get 100% of Westwood Village owner signatures (due to some owners refusal to sign, being out of the country, being unaware, and just not caring).
  • You do not need to sign the Deed of Vacation at the Open House, JBGR will give everyone a future opportunity to do so.  Furthermore, you do not need to sign the Deed of Vacation for the easement unless you wish to, although we go encourage you to.
